Brian H. Mahany brings over two decades of government experience and criminal defense work to the Bernhoft Firm. As a senior litigation partner concentrating in criminal defense – with a special emphasis on tax, white collar, and securities – Mahany also supervises the Firm’s asset protection practice.

Prior to joining the Bernhoft Firm, Mahany mastered the inner workings of government at high levels, serving for two years as Assistant Attorney General, four years as a state prosecutor, and four years as Maine’s revenue commissioner. Mahany was also elected treasurer of the Multistate Tax Commission, and was active in the Council of State Governments and Federation of Tax Administrators. While in Maine, Mahany served as Special Assistant to the President, Director of Policy. He has lectured nationally on tax policy and related issues.

During his tenure as head of Maine’s tax department, Mahany was a key player in the territorial dispute between Maine and New Hampshire, which culminated in the United States Supreme Court decision reaffirming that Seavey Island and the Portsmouth Naval Shipyard are located in Maine and not New Hampshire. As a state court prosecutor, Mahany was responsible for several appeals to Maine’s High Court.

After leaving his public service life behind, Mahany developed a vibrant criminal defense practice and obtained a remarkable string of acquittals with his creative defense strategies and formidable trial skills.

He received his Juris Doctorate in 1983 from Tulane University in New Orleans and has begun work on a second doctorate, this one in psychology.
