Bernhoft Law Wins Another Federal Election Law Case

The Bernhoft Law Firm won another First Amendment ballot access case in Idaho federal court. The firm has handled similar lawsuits in other states, including Arizona and Wisconsin.

Federal Judge Issues Full Preliminary Injunctive Relief for Arizona Green Party in Voting Rights' Case, January 15, 2010 (pdf)

Bernhoft Law sued the state of Arizona on behalf of the Arizona Green Party, alleging that several state ballot access laws violated the First Amendment's constitutional guarantee of free political speech, expression, and association.

Bernhoft Law attorneys Robert Barnes and Daniel Treuden argued in Arizona federal court on Monday, January 11th, for preliminary injunctive relief against the state, and the federal district court granted their request by today's order. The case will now move forward to the summary judgement stage, but in the meantime, any United States citizen can circulate ballot access petitions without having to be a resident of Arizona, and the court's order also gives petition circulators 14 more days to collect the requisite number of signatures.

Diamond is the son of Marilyn Diamond-Schnell and Harvey Diamond, authors of the international blockbusters Fit for Life and Fit for Life II. Marilyn Diamond has been credited by Publisher's Weekly as one of the top twenty-five bestselling authors in publishing history.

The Bernhoft Law Firm sues the Arizona Secretary of State Again Over Unconstitutional Ballot Access Restrictions (pdf)

"The Bernhoft Law Firm sued the Arizona Secretary of State in 2004 on behalf of presidential candidate Ralph Nader and others, over unconstitutional ballot access restrictions. After the federal district court ruled in Arizona's favor in 2006, Nader appealed to the U.S. Court of Appeals for the 9th Circuit. On July 9, 2008, in a decision widely haled as seminal for political choice and voting rights, a unanimous 9th Circuit ruled in Nader's favor and overturned the district court's decision and invalidated the constitutionally offensive state statutes. (See "Big Victory for Bernhoft Law in Nader Open Ballot Ruling", July 20, 2008, on this page).

But Arizona failed to heed the full scope of the federal appeal court's decision, prompting the Green Party to hire Bernhoft Law to compel Arizona to change their ballot access statutes to conform to controlling federal authority.

As reported in the Los Angeles Business Journal, Attorney Robert Bernhoft and his wife Vicki hosted the Bernhoft Law Firm's annual Holiday Party at their new Malibu beach house on Saturday, December 5th. Jonathan Goldsmith, the famous "World's Most Interesting Man" from the now-legendary Dos Equis commercials, attended, along with his lovely wife Barbara. Mr. and Mrs. Goldsmith were the guests of longtime Bernhoft friend and notable restaurateur John Vassallo.
