The Promise and Pitfalls of Civil RICO as a Fraud Recovery Tool: Video Presentation
Bernhoft Law Firm partner Dan Treuden and I had the privilege of leading a panel session at David Marchant’s Offshore Alert Conference in April of 2022. The OAC is arguably the most unique conference gathering in the country. As investigative journalist Jack Blum once observed:
“It’s like that famous bar in ‘Star Wars’, where they all come together – the good guys, the bad guys, the seriously guilty – and they all exchange information on neutral territory.”
This year’s event was no exception, with exciting panel sessions and the usual eclectic mix of attendees and observers from around the world, all gathered in one place on neutral territory to hear about current fraud scheme trends and asset recovery developments.
Our presentation focused on using the Racketeering Influenced and Corrupt Organization’s (“RICO’s”) civil cause of action to recover damages for serious frauds, including treble damages, attorney’s fees, and costs. We dug deep into civil RICO’s unique pleading requirements, jurisdictional considerations, and general litigation strategies.
